Dansk indenlandsk købsret

Studieudgaven af bogen Køb (Dansk indenlandsk købsret) er en kortere version af det noget mere omfattende hovedværk. Studieudgaven er målrettet studerende på jurastudiet, der skal have en introduktion til de køberetlige regler og dermed også til de  grundlæggende obligations-retlige regler set i lyset af internationale påvirkninger.

I bogen gives en fremstilling af reglerne i Købeloven om kravene til parternes ydelser og reglerne om misligholdelse i handelskøb, civilkøb og forbrugerkøb. 

I sidstnævnte forbrugerretlige relation omfatter denne omarbejdede 3. udgave de omfattende KBL-ændringer, som med virkning fra 1. januar 2022 implementerer EU-varedirektivet: Europa-Parlamentets og Rådets direktiv (EU) 2019/771 af 20. maj 2019 om visse aspekter af aftaler om salg af varer; desuden EU-direktivet om levering af digitalt indhold og digitale tjenester: Europa-Parlamentets og Rådets direktiv (EU) 2019/770 af 20. maj 2019.

The 1980 United Nations Convention on Contracts for the International Sale of Goods (CISG) regulates the rights of buyers and sellers in international sales. Dansk indenlandsk købsret

Bogen "Køb" handler om dansk indenlandsk købsret, dvs. køb af løsøre i henhold til Købeloven af 1906 med senere ændringer: KBL. De første ni kapitler omfatter KBL-reglerne for civilkøb og køb mellem handlende, hvorimod forbrugerkøbets særregler drøftes i et kapitel for sig.

I denne 5. udgave har forfatterne taget højde for den på retsområdet vigtigste lovgivning, retspraksis og litteratur, der er kommet siden udgivelse af bogens fjerde udgave (2015).

Det er fortsat tanken at give en introduktion til de køberetlige regler, der samtidig fungerer som en introduktion til nogle mere almindelige, obligationsretlige regler set i lyset af internationale påvirkninger.

Joseph Lookofsky er professor emeritus i Formueret ved Københavns Universitet. Han blev J.D. ved New York University School of Law (1971), senere cand. jur. (1981) og dr.jur. (1989) ved Københavns Universitet.

Vibe Ulfbeck er professor i Formueret ved Københavns Universitet, hvor hun er leder af CEVIA (Center for Virksomhedsansvar). Hun blev cand. jur. i 1990 ved Københavns Universitet, LL.M 1991 ved University of Cambridge, England og dr. jur. ved Københavns Universitet i 2000.

About the Authors:

Joseph Lookofsky is Professor Emeritus of Law at the University of Copenhagen. He is a Member of the New York State Bar and former counsel for United Artists Corporation. He holds a B.A. in Economics (Lehigh University 1967) and a J.D. (New York University School of Law 1971). Ketilbjørn Hertz is Legal Advisor with the Danish Ministry of Justice. He received degrees from the University of Copenhagen, cand.jur. in 1993 and Ph.D. in law in 1998. In 2007 he completed the Cycle international court at the Ecole nationale d’administration in Strasbourg, France. The CISG Convention and Domestic Contract Law

Harmony, Cross-Inspiration or Discord?

The University of Copenhagen, Center for Commercial Law, is proud to present the papers in this volume which cast new light on the interrelationship between key features of the United Nations Convention on Contracts for the International Sale of Goods (CISG) and domestic sales and contract law.

The Nordic region has a special interest in this project, as 2014 marks the 25th anniversary of the ratification of the CISG in most of the Nordic Countries. But the interaction between the CISG and domestic law is not merely a Scandinavian concern. CISG Article 7 expressly requires that in the interpretation of the CISG, “regard is to be had to its international character and to the need to promote uniformity in its application”. With particular emphasis on issues relating to Contract Formation, Conformity of Goods and Hardship, the authors discuss how CISG rules and principles impact on or are influenced by domestic sales and contract law, both in the Nordic region and elsewhere.
